WADA–CAS Appeals Process:
1. National Decision Issued
A national anti‑doping body (e.g., Sport Ireland) issues a decision after a results‑management process.
This may include a finding of an anti‑doping rule violation and a sanction.
⬇️
2. Athlete Reviews the Decision
You consider:
the evidence
the reasoning
the sanction
whether the rules were applied correctly
If you disagree with any part of the decision, you may appeal.
⬇️
3. Athlete’s Right to Appeal
You can appeal the national decision to the Court of Arbitration for Sport (CAS) within the required deadline.
If you appeal → the case goes to CAS.
If you do not appeal → the decision becomes final unless WADA or another body appeals.
⬇️
4. WADA and Other Bodies Review the Decision
Even if you accept the decision, the following bodies may independently review it:
WADA
Your international federation
The national anti‑doping organisation
They assess whether the decision complies with the World Anti‑Doping Code.
⬇️
5. Does WADA (or another body) Appeal?
If NO appeal is filed:
The national decision becomes final and binding worldwide.
If YES:
The case proceeds to CAS, even if the athlete did not appeal.
⬇️
6. CAS Appeal Process Begins
CAS appoints a panel (one or three arbitrators).
Both sides submit written arguments, evidence, and expert reports.
⬇️
7. CAS Hearing
A hearing is held (in person or online).
You and your legal team can present:
your explanation
scientific or medical evidence
arguments on fault, intent, or proportionality
⬇️
8. CAS Issues a Final Award
CAS may:
uphold the original decision
reduce the sanction
increase the sanction
overturn the violation entirely
This decision is final and enforceable worldwide.
⬇️
9. Global Enforcement
The CAS award is recognised by:
all national anti‑doping organisations
all international federations
WADA
major event organisers (IOC, World Athletics, etc.)
Your eligibility status is updated globally.
Key Points to Note -
You have the right to appeal to CAS if you believe the decision is unfair or incorrect.
WADA can appeal even if you choose not to.
CAS is the final authority and its decisions apply worldwide.
Early legal advice is essential because appeal deadlines are strict.
